3. Security Measures

4. Cooperation with Processors and Third Parties

6. Rights of data subjects

  1. You have the right to request confirmation as to whether the data in question is being processed and to request information about this data as well as further information and a copy of the data in accordance with Art. 15 GDPR.
  2. You have accordingly. Art. 16 DSGVO the right to request the completion of the data concerning you or the correction of incorrect data concerning you.
  3. In accordance with Art. 17 GDPR, you have the right to demand that the data in question be deleted immediately, or alternatively, in accordance with Art. 18 GDPR, to demand a restriction of the processing of the data.

7. Right of Withdrawal

8. Right to Object

You can object to the future processing of data relating to you at any time in accordance with Art. 21 GDPR. The objection can be made in particular against processing for direct advertising purposes.

9. Cookies and the right to object to direct mail

We use temporary and permanent cookies, ie small files that are stored on the user's device (for an explanation of the term and function, see the last section of this data protection declaration). Some of the cookies are used for security or are required for the operation of our online offer (e.g. for the presentation of the website) or to save the user decision when confirming the cookie banner. In addition, we or our technology partners use cookies for range measurement and marketing purposes, about which users are informed in the course of the data protection declaration.

10. Deletion of Data

  1. The data processed by us will be deleted or their processing restricted in accordance with Art. 17 and 18 GDPR. Unless expressly stated in this data protection declaration, the data stored by us will be deleted as soon as they are no longer required for their intended purpose and the deletion does not conflict with any statutory storage requirements. If the data is not deleted because it is required for other and legally permissible purposes, its processing will be restricted. This means that the data will be blocked and not processed for other purposes. This applies, for example, to data that must be retained for commercial or tax reasons.
  2. 11. Provision of contractual services

  1. We process inventory data (e.g. names and addresses as well as contact details of users), contract data (e.g. services used, names of contact persons, payment information) for the purpose of fulfilling our contractual obligations and services in accordance with Article 6 Paragraph 1 lit b. GDPR. The entries marked as mandatory in online forms are required for the conclusion of the contract.
  2. Users can optionally create a user account, in particular by being able to view their orders. As part of the registration, the required mandatory information is communicated to the users. The user accounts are not public and cannot be indexed by search engines. If users have terminated their user account, their data will be deleted with regard to the user account, subject to their retention being necessary for commercial or tax reasons in accordance with Article 6 (1) (c) GDPR. It is the user's responsibility to back up their data before the end of the contract in the event of termination. We are entitled to irretrievably delete all of the user's data stored during the contract period.
  3. As part of the registration and renewed registrations as well as the use of our online services, we save the IP address and the time of the respective user action. The storage takes place on the basis of our legitimate interests, as well as the user's protection against misuse and other unauthorized use. In principle, this data will not be passed on to third parties unless it is necessary to pursue our claims or there is a legal obligation to do so in accordance with Article 6 (1) (c) GDPR.
  4. We process usage data (e.g. the websites of our online offer visited, interest in our products) and content data (e.g. entries in the contact form or user profile) for advertising purposes in a user profile, for example to show the user product information based on the services they have previously used.
  5. Deletion takes place after statutory warranty and comparable obligations have expired, the necessity of storing the data is checked every three years; in the case of legal archiving obligations, the deletion takes place after their expiry (end of commercial law (6 years) and tax law (10 years) storage obligation); Information in the customer account remains until it is deleted.

12. Contact

  1. When contacting us (via contact form or e-mail), the information provided by the user will be processed to process the contact request and its processing in accordance with Article 6 (1) (b) GDPR.
  2. User information can be stored in our Customer Relationship Management System (“CRM System”) or comparable inquiry organization.
  3. We use the CRM system "Helpdesk" from the provider Help Scout Inc., 131 Tremont St, Boston, MA 02111-1338, US, based on our legitimate interests (efficient and fast processing of user inquiries). For this purpose, we have concluded a contract with Help Scout with so-called standard contractual clauses, in which Help Scout undertakes to process user data only in accordance with our instructions and to comply with EU data protection standards.   4. We delete the requests if they are no longer necessary. We review necessity every two years; We store inquiries from customers who have a customer account permanently and refer to the information on the customer account for deletion. In the case of legal archiving obligations, the deletion takes place after they have expired (end of commercial law (6 years) and tax law (10 years) storage obligation).

13. Comments and Contributions

  1. If users leave comments or other contributions, their IP addresses are stored for 7 days on the basis of our legitimate interests within the meaning of Article 6 (1) (f) GDPR.
  2. This is for our security if someone leaves illegal content in comments and posts (insults, forbidden political propaganda, etc.). In this case, we can be prosecuted for the comment or contribution and are therefore interested in the identity of the author.

14. Gravatar profile picture retrieval

We use the Gravatar service from Automattic, Inc. 132 Hawthorne Street San Francisco, CA 94107, USA within our online offering and in particular in the blog.

Gravatar is a service where users can register and store profile pictures and their email addresses. If users leave posts or comments with the respective e-mail address on other online presences (especially in blogs), their profile pictures can be displayed next to the posts or comments. For this purpose, the e-mail address provided by the users is transmitted to Gravatar in encrypted form for the purpose of checking whether a profile has been saved for it. This is the sole purpose of sending the email address and it will not be used for any other purpose, but will be deleted afterwards.

Gravatar is used on the basis of our legitimate interests within the meaning of Article 6 (1) (f) GDPR, since we use Gravatar to offer the authors of contributions and comments the opportunity to personalize their contributions with a profile picture.

By displaying the images, Gravatar learns the IP address of the user, as this is necessary for communication between a browser and an online service. Further information on the collection and use of data by Gravatar can be found in Automattic's data protection information: https://automattic.com/privacy/.

If users do not want an avatar linked to their Gravatar email address to appear in the comments, you should use an email address that is not stored with Gravatar to comment. We also point out that it is also possible to use an anonymous e-mail address or no e-mail address at all if the user does not want their own e-mail address to be sent to Gravatar. Users can completely prevent the transfer of data by not using our comment system.

15. Akismet Anti-Spam Check

Our online offering uses the "Akismet" service provided by Automattic, Inc. 132 Hawthorne Street San Francisco, CA 94107, USA. Use is based on our legitimate interests within the meaning of Article 6 (1) (f) GDPR. With the help of this service, comments from real people are distinguished from spam comments. For this purpose, all comment information is sent to a server in the USA, where it is analyzed and stored for four days for comparison purposes. If a comment has been classified as spam, the data will be stored beyond this time. This information includes the name entered, the email address, the IP address, the comment content, the referrer, information about the browser used and the computer system and the time of the entry.

Users are welcome to use pseudonyms or not to enter their name or email address. You can completely prevent the transfer of data by not using our comment system. That would be a pity, but unfortunately we don't see any other alternatives that work just as effectively.

16. Collection of access data and log files

  1. On the basis of our legitimate interests within the meaning of Article 6 (1) (f) GDPR, we collect data about every access to the server on which this service is located (so-called server log files). The access data includes the name of the accessed website, file, date and time of access, amount of data transferred, notification of successful access, browser type and version, the user's operating system, referrer URL (the previously visited page), IP address and the requesting provider .
  2. Log file information is stored for a maximum of seven days for security reasons (e.g. to investigate misuse or fraud) and then deleted. Data whose further storage is required for evidence purposes are excluded from deletion until the respective incident has been finally clarified.

17. Online social media presence

  1. We maintain online presences within social networks and platforms in order to be able to communicate with the customers, interested parties and users active there and to be able to inform them about our services there. When calling up the respective networks and platforms, the terms and conditions and data processing guidelines of their respective operators apply.
  2. Unless otherwise stated in our data protection declaration, we process user data if they communicate with us within social networks and platforms, e.g. write posts on our online presence or send us messages.

18. Cookies & Audience Measurement

  1. Cookies are pieces of information that are transmitted from our web server or web servers of third parties to the web browser of the user and stored there for later retrieval. Cookies can be small files or other types of information storage.
  2. We use "session cookies", which are only stored for the duration of the current visit to our online presence (e.g. to enable the storage of your login status or the shopping cart function and thus the use of our online offer at all). The IP address is not merged with the user's data within other Google offers. The above information can also be combined by Google with such information from other sources. If the user then visits other websites, the ads tailored to his interests can be displayed to him.
  4. User data is processed pseudonymously as part of Google Marketing Services. This means that Google does not store and process, for example, the name or e-mail address of the user, but processes the relevant data in relation to cookies within pseudonymous user profiles. This means that from Google's point of view, the ads are not managed and displayed for a specifically identified person, but for the cookie owner, regardless of who this cookie owner is. This does not apply if a user has expressly allowed Google to process the data without this pseudonymization. The information collected by Google Marketing Services about users is transmitted to Google and stored on Google's servers in the USA.
  5. The Google marketing services we use include the online advertising program "Google AdWords". In the case of Google AdWords, each AdWords customer receives a different "conversion cookie". This means that cookies cannot be tracked via the websites of AdWords customers. The information obtained with the help of the cookie is used to create conversion statistics for AdWords customers who have opted for conversion tracking.
